Horse country, mostly, and it is running out. Denton County covers about 953 square miles north of Dallas and Fort Worth, and it is three landscapes at once — Eastern Cross Timbers through the middle, Grand Prairie west, Blackland Prairie east. It also sits over the Barnett Shale, so on a large share of Denton County tracts the mineral estate was severed a generation ago or more.
Because the Eastern Cross Timbers cut a band straight through the center of the county, and the ground changes when you cross it. In the timbers you get sandier soil, post oak cover, and rolling relief. West of that band the Grand Prairie opens up — shallower soil over limestone, thinner grass. East toward the Collin County line you pick up Blackland clay.
The sandy Cross Timbers ground around Argyle, Aubrey, Pilot Point, and Krum is why Denton County became horse country — it drains, it builds, it holds a fence line, and it is easy on legs. The prairie ground west and east handles cattle and hay. Practically, sandy ground percs better for septic and supports conventional foundations more easily than the Blackland counties east of Dallas, but it holds ponds poorly, so expect to bring clay or a liner.
Very often not the surface owner. Portions of Denton County sit atop the Barnett Shale, and the county saw sustained drilling and leasing through the shale era, much of it in and around developed areas. The record is dense with reservations, leases, pooling agreements, and pipeline easements.
Texas recognizes a severed mineral estate, and that estate is dominant — it carries an implied right of reasonable surface use. Minerals do not convey unless the deed conveys them. Before closing, get in writing what percentage of the minerals transfers to you, whether a lease is producing and who operates it, whether the tract is pooled, and whether any surface use agreement, pipeline easement, or pad site exists and where. Differently from Collin County next door, which is the point. Denton Central Appraisal District has no minimum acreage requirement for 1-d-1 open-space valuation except for beekeeping. Collin Central Appraisal District, by contrast, looks for roughly ten acres and two animal units grazing year-round.
Same statute, two counties sharing a line, two standards. That is what Tax Code §23.51 means when it leaves degree of intensity to each district — and why nobody should quote you a statewide acreage minimum, because there is not one. No minimum acreage is not the same as no standard: DCAD still applies a degree-of-intensity test to the use itself, and horses kept for personal riding generally do not qualify as agricultural on their own.
Deadlines are uniform: file January 1 through April 30 on Comptroller form 50-129; late applications may be accepted with a 10% penalty on the tax difference; and a new owner must file a new application after closing. Rollback under Tax Code §23.55 runs three years, with no interest on the rollback itself since HB 3833 took effect June 15, 2021. More in the ag exemption guide and rollback taxes.
Surface water is abundant and mostly spoken for. The Elm Fork of the Trinity River was dammed in 1920 to create what became Lewisville Lake, and again upstream in 1986 by the Corps of Engineers to form Ray Roberts Lake. Grapevine Lake touches the southern end.
Rural tracts still run on wells, and Denton County sits inside the North Texas Groundwater Conservation District with Collin and Cooke counties. The district administers Trinity and Woodbine production and separates exempt from permitted wells by capacity — its published criterion for new wells is under 17.36 gallons per minute for exemption from permitting, metering, reporting, and fees. Confirm current rules with the district, and find out whether the well you are buying is on file. For stock tanks, Texas Water Code §11.142 allows impoundment up to 200 acre-feet for domestic and livestock use without a permit; commercial use is excluded.
Some, concentrated in the northern tier around Pilot Point, Aubrey, Sanger, Slidell, and the Cooke and Wise county lines. The southern half is largely built out or entitled. Anything with paved frontage south of US 380 is priced as development ground regardless of what grazes on it today.
For most agricultural uses that is the district's published position, with beekeeping the exception. It is not a low bar. Degree of intensity still applies, meaning the district evaluates whether the operation is run to the standard typical for the area. Confirm your specific use with DCAD before you rely on it.
Usually, subject to extraterritorial jurisdiction, county road and drainage requirements under Local Government Code Ch. 232, septic approval under Health & Safety Code Ch. 366, and whatever the mineral owner's surface rights allow. Start with building on rural land in Texas.
The range from a north-county hay meadow to an entitled tract near US 380 is wide enough that a county average would be meaningless. We do not publish one for that reason. Ask us for current figures on the specific corridor you are shopping.
