What should a buyer know about land in Ellis County, Texas?

Ellis County is about 939 square miles of Blackland Prairie directly south of Dallas, and its defining feature is underfoot: Houston Black clay, the Texas state soil, 60 to 80 percent smectite. Some of the most fertile ground in the world and the most demanding to build on. Add I-35E, I-45, and US 287 converging here and you get farmland under real conversion pressure.

Why does the soil come first in Ellis County?

Because it governs everything else. Houston Black is the textbook vertisol — heavy black clay that swells when wet and shrinks and cracks when dry — and Ellis is one of the counties where it is most extensive. Three consequences a buyer feels immediately:

  1. Foundations. A slab here needs an engineer and a soils report on your tract, not a spec design. Seasonal movement is not a defect; it is the soil doing what it does.
  2. Septic. Tight clay percolates poorly. Conventional drain fields often will not pass and an aerobic system is frequently the answer. On-site sewage facilities are governed by Health & Safety Code Ch. 366, administered through the county as TCEQ's authorized agent — see building on rural land.
  3. Everything agricultural works. This is why Ellis was cotton country and why it still grows wheat, corn, and milo. Improved pasture is productive, hay meadows are worth real money, and a stock tank holds without a liner.

How much development pressure is on Ellis County land?

A lot, and it is concentrated. Midlothian, Waxahachie, and Ennis are all growing hard, and the corridors feeding them — I-35E, US 287, US 67 — are where farmland is converting. TxDOT continues to study Loop 9 across the Dallas and Ellis county line. That creates a risk you will not meet in Hunt or Van Zandt County: you may be buying agricultural-valued land you intend to develop, and the rollback tax follows.

Under Tax Code §23.55, rollback is triggered by a change of use, not by the sale. HB 1743 (86th Legislature, effective September 1, 2019) cut the lookback from five years to three and the interest from seven percent to five percent. HB 3833 (87th Legislature, effective June 15, 2021) then removed interest from §23.55 altogether, so a change of use on or after that date carries no interest on the rollback itself. Who regulates groundwater in Ellis County?

The Prairielands Groundwater Conservation District, created in 2009 by the 81st Texas Legislature after TCEQ found groundwater shortages were expected across Ellis, Hill, Johnson, and Somervell counties over a twenty-five-year horizon. Board members are appointed by the four commissioners courts.

That distinguishes Ellis from its eastern neighbors. Kaufman, Rockwall, Hunt, and Van Zandt are in no groundwater district. Ellis is. If a tract has a well or you intend to drill, contact Prairielands about registration, permitting, spacing, and reporting. Under Edwards Aquifer Authority v. Surface water is separate: Texas Water Code §11.142 permits impoundment up to 200 acre-feet for domestic and livestock use, commercial excluded. Bardwell Lake, built by the Corps of Engineers in 1965 southwest of Ennis off SH 34, is the county's main reservoir.

What does ag valuation look like through Ellis Appraisal District?

The Ellis Appraisal District in Waxahachie sets its own degree-of-intensity and minimum acreage standards. Blackland carrying capacity is higher than Cross Timbers, so the district generally expects more production from a given acreage than a district west of Fort Worth would.

Applications are due January 1 through April 30 on Comptroller form 50-129; late filings may be accepted with a 10% penalty on the tax difference; and a change of ownership requires the new owner to file a new application. Is Ellis County land a farm buy or a development buy?

Increasingly both, and the corridor determines which. Ground within reach of Midlothian, Waxahachie, and Ennis prices against future rooftops. The eastern half of the county toward Palmer, Ferris, and the Kaufman County line, and the southern end toward Navarro County, still trades as farm and pasture. Know which one you are buying before you sign.

Can I subdivide a tract in Ellis County?

County subdivision and platting authority sits under Local Government Code Ch. 232, and in Ellis County a tract may also fall inside a city's extraterritorial jurisdiction, which brings municipal platting rules into play on top of county requirements. Confirm both jurisdictions before you assume a split is administrative.

Are minerals an issue in Ellis County?

Less than in the Barnett Shale counties west of Fort Worth, but Texas severs minerals freely and severance is common statewide. Ask the title company what conveys and whether a lease or pipeline easement is of record. Ellis County also has significant limestone and cement operations, so aggregate and quarry interests are worth asking about specifically.

What is land selling for per acre in Ellis County?
